TERMS & CONDITIONS OF PURCHASE and Membership of Loyalty Club
By placing an order at this website purchasers agree to the following terms and conditions
These terms and conditions apply to purchases made on this web site
Important
Due to the high incidence of credit card fraud The Pet Shop Boyz will contact first time purchasers if your order is more than $255 to verify order and payment details. This is to prevent credit card fraud.
· The name of an order must match the name of the credit card used to pay for the order.
· The credit card billing address must match the delivery address of the order.
· Stock Items that are: 1 metre in length; Weigh more than 20kg and are flammable items will not be sent to PO BOX's.
· New purchasers outside Australia may be asked to complete a signed declaration and return it to us by fax or scanned copy before orders are despatched.
Orders will not be despatched where order details submitted or verification processes are incomplete.
ORDER PROCESS
FIRST TIME CUSTOMERS PURCHASING VIA CREDIT CARD
· When you place your order via credit card, the order is held in our system pending verification for the first time if the total order is more than $255.
· All orders will receive a confirmation letter and a verification letter via email. Please read carefully. If you would like a clear printout of the verification letter please go to:credit card verification.
· Our staff will debit a small mystery amount from your nominated credit card and will require confirmation by the purchaser before goods are dispatched. The mystery amount will be credited towards your purchase. This again is to prevent credit card fraud.
· Once confirmed and verified, your payment will be processed and your order dispatched from our warehouse to your street address. You will receive email updates regarding the progress of your order through our system.
NOTE: ALL FIRST TIME INTERNATIONAL CUSTOMERS WILL NEED TO VERIFY REGARDLESS OF THE AMOUNT
1. ORDERS & DELIVERY
· All orders placed through this website are subject to confirmation and acceptance by the Pet Shop Boyz.
· The Pet Shop Boyz normal freight charges do not involve a unique id or tracking number. Please not The Pet Shop Boyz are not liable for items that are lost or stolen during transit and you will not be compensated unless you select the insurance option.
· The Pet Shop Boyz offer Registered Post that includes: a unique id to track your goods or service to your delivery address. Australia Post will compensate up to $100.
· The Pet Shop Boyz will notify you of price increases that affect your order. You may at that time cancel your order if need be.
· Orders will be delivered to the address registered in your profile, within the agreed timeframe, subject to their availability.
· If goods are returned to the Pet Shop Boyz due to delivery problems, then the Pet Shop Boyz will charge additional freight fees to your account.
· Once goods have left our warehouse, loss or damage to the goods become your responsibility.
· If goods are ordered and only some of them are not in stock. The Pet Shop Boyz will despatch the goods that are available and provide free freight for the stock that is on order once available.
· If goods are ordered and sent to overseas countries then it is soley the receivers responsibility to clear the goods through customs and quarantines authorities in their country. The Petshop Boyz will only invoice out the correct name number of items and true contents for all packages going overseas. It is a felony to mislead customs and quarantine and The Petshop Boyz will abide by local laws in this regard. You should check your local quarantine and customs regulations before you place an order for goods to be sent to your country. The Petshop Boyz will not be held responsible for any charges imposed,confiscations, obstructions or refusals to enter goods in foreign ports ordered by you through this site or directly with The Petshop Boyz after viewing this site. Goods sent overseas are sent on your thorough understanding of your countrys' entry requirements and any risks associated with entry to foreign countries is sloely the responsibility of the person making an order. Charge backs cannot be claimed for failure to gain entry through foreign customs and quarantine. If goods are returned back to The Petshop Boyz as a result of foreign customs or quarantine regulations the it is the responsibility of the person making the order to meet all freight costs for the delivery and return of the goods to the foreign country. In addition there will be a 20% restocking fee for all goods returned. If goods are not returned in original condition and quantity then a charge back cannot be considered.
LORD HOWE ISLAND AND OTHER ISLAND ANNOUNCEMENT:
All customers that are living on an island off the mainland of Australia, apart from Tasmania may incur extra freight costs. The Pet Shop Boyz will not hold the responsibility or be liable to pay for those costs. If you live on an island such as: Lord Howe Island or another island. Please do not order unless you consult with The Pet Shop Boyz to see if your order will incur extra freight costs.
2. RETURNS & REFUNDS
Pet Shop Boyz has a Returns Policy. Please refer to this returns policy if you need to contact us about a return or a refund.

3. PRICES & PAYMENT
· For each online order you must pay: the applicable price for the relevant goods confirmed by the Pet Shop Boyz; and the delivery and handling fee specified on the website.
· Prices quoted on the website do not include local customs, government duties or taxes which may be applied to international orders.
· The purchaser is responsible for the above charges and the Pet Shop Boyz cannot advise on or otherwise represent local charges that may or may not apply to international orders.
· We accept payments using the methods stated in the orders & payment section of this website.
· Payment must be cleared before goods are despatched.
· Prices are subject to change at any time, without notice.
· Confidential information including client credit card details are encrypted when they are transmitted from the client's browser using industry standard SSL 128-bit RC4 encryption technology.
4. CHARGEBACKS
If a purchaser initiates a chargeback relating to a purchase made at this website and that chargeback is successful through the banking system then Pet Shop Boyz, will lodge a formal credit card fraud report with NSW Police and the Australian Federal Police. At this time any and all information relating to the purchase will be provided to the police to assist with their investigation. Pet Shop Boyz is pro-active in resolving matters of dispute promptly therefore legitimate grounds for chargeback’s rarely if ever occur between Pet Shop Boyz and its purchasers.
5. YOUR ACCOUNT
You agree to take responsibility for the safekeeping of your user name and password. You are liable if your user name or password is used by an unauthorised person. You agree to release and indemnify Pet Shop Boyz in connection with any use (whether authorised or unauthorised) of your user name or password. Pet Shop Boyz may suspend or cancel your account at any time without prior notice.
6. PICTURES
Pet Shop Boyz aims to include up-to-date pictures of all of the goods on this web site. However, our picture of the goods may differ from the actual goods and are provided for the purposes of illustration only. We recommend you read the labels on the goods carefully before using the goods.
7. PRIVACY
Pet Shop Boyz will comply with Pet Shop Boyz Privacy Statement. Pet Shop Boyz will not reveal your personal information to external organizations except for the purposes of fulfilling your order.
8. LIABILITY
Any liability of Pet Shop Boyz in connection with goods or services supplied to you will, subject to any non-excludable liability for breach of conditions or warranties implied by legislation and to the maximum extent permitted by law, at the election of Pet Shop Boyz be limited to: in relation to goods, the replacement of the goods or the supply of equivalent goods; and in relation to services, the supplying of the services again or the payment of the cost of having the services supplied again.
9. CHANGES TO TERMS
Each order is governed by the terms and conditions current when the order is placed. Pet Shop Boyz may add to, delete or otherwise change these terms and conditions without notice. It is your responsibility to read and understand these terms and conditions each time you place an order.
10. APPLICABLE LAW
All purchases under this web site and these terms and conditions are subject to the laws of New South Wales, Australia.

12. TERMS FOR LOYALTY CLUB MEMBERSHIP

By receiving a Petshop Boyz Loyalty Club Card the applicant agrees to be bound by the The Petshop Boyz loyalty club terms and conditions. These terms and conditions are binding on the member upon the issue of a Card to the applicant.

Only individuals can apply for a Card. Trusts, partnerships, joint ventures,associations,corporations or cannot apply.

The Petshop Boyz may, in its absolute discretion and without giving reasons for its decision, accept or refuse an applicant for a Card.

To apply for membership the cardholde must complete The Petshop Boyz online Member Club application form and submit it via the button at the bottom of the form.

A Cardholder may hold one (1) Card only.

Cardholder rights are determined by The Petshop Boyz from time to time and may include discounts for products purchased at The Petshop Boyz stores.

Discounts only apply to the Cardholder noted on the Card and may not be used in conjunction or combination with any other offer or promotion.

Cardholder discounts are not available on goods at “sale” or “special” prices.

The rights of a Cardholder are non-transferable and not redeemable for cash.

Cardholder rights are valid until terminated or cancelled by The Petshop Boyz (in its absolute discretion) or until the Cardholder notifies their nominated Petshop Boyz store that he or she wishes to terminate their Card. If a Card is terminated the Cardholder must return the Card by hand to the nominated Petshop Boyz store.

The Petshop Boyz may, in its absolute discretion and without giving reasons for its decision, at any time and without notice cancel any Card or substitute advertised discounts for any other item of a comparable value.

The Petshop Boyz is not responsible for stolen or lost Cards or Cards that are used fraudulently. The Cardholder must report a stolen or lost Card to The Petshop Boyz immediately. The Cardholder’s existing Card will be cancelled and a new Card issued.

All Cards remain the property of The Petshop Boyz. Cards must be returned to The Petshop Boyz immediately on demand by The Petshop Boyz.

Any questions regarding the The Petshop Boyz Member Club should be referred to a local The Petshop Boyz store.

The Petshop Boyz reserves the right to suspend or terminate the The Petshop Boyz Member Club at any time and without prior notice.

The Petshop Boyz shall not be liable in any way if benefits or promotions are unavailable as a result of a technical malfunction, operator fault, errors resulting from computer hardware or software errors or failure.

The Petshop Boyz Loyalty Club, components of the The Petshop Boyz Loyalty Club and its associated promotions may be amended or withdrawn by The Petshop Boyz at any time without notice.

Cardholders participating in The Petshop Boyz Loyalty Club and it’s associated promotions are bound by these terms and conditions and are subject to any other conditions imposed by The Petshop Boyz from time to time.

All discounts for Cardholders for purchases at The Petshop Boyz stores are subject to availability.

Cardholder discounts are not negotiable, non transferable, or redeemable for cash.

A Cardholder must produce their Card if seeking the benefit of any discount or other benefit offered to Cardholders, or upon request by The Petshop Boyz. Loyalty points or discounts will not be added back to accounts if the card is not produced at the point of sale.

The Petshop Boyz does not warrant in any way that the discounts or benefits for Cardholders will be available at any particular time or times or in any particular place.

To the greatest extent permitted by law, The Petshop Boyz gives no warranty and shall have no liability in respect of goods or services provided to Cardholders or as to the accuracy of any description or information about such goods or services, even though The Petshop Boyz may have notified the Cardholder of those goods or services.

The Petshop Boyz is not liable in any way whatsoever for any injury or loss (including any indirect or consequential loss) of any kind to person or property suffered by any Cardholder whether by reason of any act or omission, deliberate or negligent, of The Petshop Boyz in connection with the The Petshop Boyz Loyalty Club, including injury or loss incurred whilst participating in any activity of the The Petshop Boyz Loyalty Club or The Petshop Boyz or in any activity in which Cardholders are invited to participate. This condition is subject to any liability with may not be lawfully excluded, in which case such liability will be limited to the greatest extent permitted by law.

The Petshop Boyz makes no warranty or representation as to the quality, suitability or merchantability of any goods or services offered as prizes.

Cardholders indemnify The Petshop Boyz for and against any loss or claim suffered or incurred by The Petshop Boyz arising from or in connection with a breach of these terms and conditions by a Cardholder.

The Petshop Boyz reserves the right to vary these terms and conditions at any time for any reason and without notice to Cardholders. A copy of the current The Petshop Boyz Member Club terms and conditions can be obtained from www.Petshopboyz.com.au.

The Petshop Boyz holds and uses a Cardholder’s personal information in accordance with The Petshop Boyz’s privacy policy (a copy of which can be viewed at www.Petshopboyz.com.au).

The Petshop Boyz’s decision in connection with any aspect of the The Petshop Boyz Loyalty Club will be binding and final on each Cardholder.

"The Petshop Boyz" means Buy Pet and Rural Pty Ltd T/A The Petshop Boyz ABN 71 647 492 323 and includes where appropriate The Petshop Boyz’s employees, agents, and contractors, officers and related bodies corporate (as that term is defined in the Corporations Act 2001 (Cth)). "Cardholder" means a person who has applied for a Card and whose application has been accepted by The Petshop Boyz.
For the avoidance of doubt, these terms and conditions supersede and replace any and all previous terms and conditions specifically governing the The Petshop Boyz Loyalty Club.
